Terms and Conditions of www.bookasauna.ie (Sauna Owners)
These Terms and Conditions for Sauna Owners (including the Terms and Conditions of Use of Website) constitute a contract between the Sauna Owner and Lorraine Collins trading as www.bookasauna.ie with address 12/15 Killegland Street, Ashbourne, Co Meath (hereinafter referred to as “Us or “We” or “Book a Sauna” or “www.bookasauna.ie”).
Book A Sauna is an online registry and booking website, connecting Sauna Owners with Customers. It is accessible at www.bookasauna.ie (“Website”). Sauna Owners can register and upload information about the services they provide, and customers can access this information and book a service. By registering on this Website, you (“Sauna Owner”) agree with Lorraine Collins trading as www.bookasauna.ie (hereinafter www.bookasauna.ie or Book a Sauna) to the following Terms and Conditions as well as the Terms and Conditions of Use of the Website also contained on www.bookasauna.ie . This agreement (“Agreement”) is valid from the date of registration for a period of one year. This agreement involves Sauna Owners contracting Bookasauna.ie to provide an independent sauna listing and booking website service.
1. Registration and Subscription
1.1. Registration Fee: A non-refundable registration fee of €300 per year is required for listing on the Website.
1.2. Term of Agreement/Termination: The Agreement is valid for one year from the date of registration. Sauna Owner will receive an email at least 14 days in advance of the expiry of one year from your registration and each year thereafter providing an option to renew the service for another year. If Book a Sauna does not hear from you but you continue using the service the subscription will automatically renew for another year. If Book a Sauna does not hear from you and you do not use the service for 4 weeks after the renewal point then Book a sauna have the option to end the service of the Sauna User but the Sauna User will have the option to begin the service again on the usual terms at any time. If the terms of this agreement are not adhered to Book A Sauna may terminate an account with immediate effect.
2. Sauna Owner Responsibilities
2.1. Representation: The registered Sauna Owner confirms that they have the authority to represent the sauna business listed on the Website. www.bookasauna.ie may request evidence to verify the Sauna listing at any stage over the term of this agreement.
2.2. Accurate Information: By creating an account, the Sauna Owner takes responsibility for ensuring that the information they provide is accurate, appropriate, current and complies with all applicable laws. The Sauna Owner must ensure that all information provided remains accurate and up-to-date. Any content uploaded by the Sauna Owner (pictures, videos, information, links, phone numbers etc) must be accurate and the Sauna Owner must have permission to use such content.
2.3. Review of Terms: These terms and conditions should be reviewed regularly by the Sauna Owner to stay informed of any changes.
2.4 Use of website: The website shall only be used for the purposes outlined in this document; as a booking platform for professional Saunas.
2.5 Confidentiality: The Sauna Owner is responsible for maintaining the secrecy of their log in details and password at all times. The Sauna Owner is responsible for any and all use of the Website by anyone using their login information/password whether with or without their permission. The Sauna Owner may not give access to any third party.
3. Book A Sauna Responsibilities
3.1 Book A Sauna will promote the Sauna Owner’s business, to prospective customers through Social Media and by other promotional means.
4. Privacy
4.1. Privacy Policy: The Privacy Policy, available at www.bookasauna.ie, governs how we collect, use, and protect your personal information. By registering on the site the Sauna Owner agrees to comply with the terms of the Privacy Policy.
4.2 Each Sauna Owner is required to have their own Privacy Policy demonstrating compliance with GDPR and the Sauna owner will be a joint data controller along with Book a Sauna. The Sauna owner will ensure that their Terms and Conditions with Sauna Users refers to and binds Sauna Users as regards their Privacy Policy. The Sauna Owner will tick to confirm they agree to these matters and to having a GDPR compliant Privacy Policy as part of the registration process. Book a sauna reserves the right to review the Privacy Policy and also Terms and Conditions of Sauna Owners and to request that certain changes be made failing which Book a Sauna reserve the right to terminate their contract with the Sauna Owner upon written notice of 7 days reimbursing the Sauna Owner for any element of their registration fee that may relate to unexpired term of their registration fee period.
4.3 Each Sauna Owner may only market to Sauna Users upon receiving consent to do so either directly themselves or by book a sauna receiving consent for Sauna Owner to be in a position to do so.
5. Limitation of Liability/ Indemnity/ Insurance
5.1. Service Liability: Book A Sauna is not liable for any part of the sauna service provided by the Sauna Owner. The Sauna Owner is solely responsible for the services they provide to their customers or Sauna Users as introduced by Book a Sauna.
5.2. Service Liability: Book A Sauna is not liable for any part of the sauna services provided by the registered Sauna Owners. All services are the sole responsibility of the Sauna Owners. No liability whatsoever will result for Bookasauna.ie with any issue with provision of the service by Sauna Owners, including any issue with possible breach of contractual obligation for the provision of the service or any issue with regard to the duty of care owed by the Sauna Owner to the Sauna User. For the avoidance of doubt any negligence or reckless action by the Sauna owner resulting in any injury of any kind either physical or mental or financial to the Sauna User is the sole responsibility of the Sauna Owner and no liability for negligence or breach of duty or recklessness will accrue for www.booksauna.ie with regard to any element of the service provision by the Sauna Owner to the Sauna User.
5.3. Quality and Safety: www.booksauna.ie is not in any way liable for the quality of the service provided by Sauna Owners or for any accident, illness, injury, financial loss or death that may arise from the use of a sauna. Users must be advised by Sauna Owners to take appropriate precautions and consult with a healthcare provider if necessary before using sauna services and to discuss same with the individual Sauna Owners.
5.4. Availability: Book A Sauna is not responsible if Sauna Owners become unavailable to provide the service booked. Any issues regarding availability or with regard to cancellations or refunds must be addressed directly with the Sauna Owner.
5.5. Payment and Contract: All payments go directly to the Sauna Owner. www.bookasauna.ie does not charge a commission on bookings; therefore, the contract for the service is between the Sauna User and the Sauna Owner and does not involve www.bookasauna.ie.
5.6 The services, www.bookasauna.ie Website, system, access to the system, and the information contained on the system are provided on an “as is” and “as available” basis without any warranties of any kind, either expressed or implied. Under no circumstances shall we be liable for any special, indirect, consequential, remote, or exemplary damages, including but not limited to loss of profits or revenues, loss of use, or loss of information or data. This applies whether the claim is based on breach of contract, breach of warranty, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. We disclaim all liability for any erroneous transmissions and loss of service resulting from communication failures by Sauna Owners or the system.
5.7 You acknowledge that other users also have access to the system and receive our services. These users have agreed to comply with our terms and conditions regarding the use of the system. However, their actions are beyond our control, and therefore, we do not assume any liability for their actions.
5.8 Indemnity: The Sauna Owner shall also be liable to indemnify Book A Sauna for any unlawful disclosure of information of the Customer, damage, death, injury, other mishap or any complications that require additional treatment, caused to the Customer due to the negligence of the Sauna Owner and/or its staff performing their duty or fulfilling their obligations as a provider of Sauna Services under this Agreement. Book A Sauna shall not be liable for or be made a party to any claim that may be made against the Sauna Owner by the Customer concerning the events organized by the Sauna Owner. Book A Sauna shall not be liable for any liability for incidental, consequential, indirect, special, punitive damages or liabilities of any kind, or for loss of revenue, loss of business or other financial loss arising out of or in connection with this Agreement, regardless of the form of action, whether in contract, tort (including negligence) or otherwise, even if any representative of a Party has been advised of the possibility of such damages. Book A Sauna’s aggregate liability arising or accruing under this Agreement for any damages shall not exceed 250 EUR [two hundred and fifty EURO].
5.9 Insurance: The Sauna Owner will at the time of registering on the website also submit a copy of their current insurance policy providing for public liability insurance coverage with a minimum cover of €6,500,000 and demonstrating that all of the risks mentioned herein are covered by said Insurance Policy and also that www.bookasauna.ie are indemnified with regard to the risks arising under clauses 5.1 and 5.2.
6. Payments
6.1 Book A Sauna is not responsible or liable for any payments to Sauna Owners as a result of booking of services. As part of the booking process customers will make payment directly to the Sauna Owner.
7. Modifications to the Terms and Conditions
7.1. Changes to Agreement: Book A Sauna reserves the right to modify these terms and conditions at any time. Changes will be posted on the Website, and it is the Sauna Owner’s responsibility to review the terms regularly.
8. Governing Law
8.1. Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.
